1. REGISTRATION

2. PREAMBLE

1. The following terms and conditions govern the use of the Website owned and/or operated by Highgrounds BLVD.
2. The Website is an online platform providing access to exclusive membership to our members-only cannabis club and tickets to exclusive events offered by Highgrounds BLVD.
3. By registering, accessing, or using the Website, you agree to be legally bound by this Agreement regardless of whether you have expressly signed or assented to these terms and conditions.
4. If you do not understand the terms of this Agreement, it is your responsibility to seek clarity from Highgrounds BLVD before accepting the terms stipulated herein or continuing to use the Website.
5. You must not use the Website if you disagree with these terms and conditions stipulated herein.

3. USE OF THE WEBSITE

1. To register as a [Client/Customer/Member], you must provide Highgrounds BLVD with the required personal details which must be filled in on the registration form available on this website. Upon approval, you will be provided with a unique username and password (“Credentials”).
2. Access to certain domains of the Website may be restricted and will be available only after successful registration.
3. You agree that once the correct Credentials are entered, you will be held responsible for all activities conducted under your account even if such use is unauthorized or fraudulent unless you have promptly notified Highgrounds BLVD of any unauthorized use.
4. You agree to notify Highgrounds BLVD immediately upon becoming aware of any unauthorized access to your Credentials.
5. Highgrounds BLVD reserves the right to terminate unconfirmed and/or inactive accounts. Additionally, we may refuse or terminate all or part of our services provided to you on reasonable grounds.

4. RECORDAL

1. Highgrounds BLVD shall provide services to you as outlined herein which you accept in exchange for payment of such services.
2. The parties agree to the terms and conditions upon which Highgrounds BLVD shall render services to you.

5. DURATION

1. This agreement is effective from the registration date and remains valid unless terminated as per these terms.
2. Either party may terminate the agreement with two weeks’ written notice or in accordance with this agreement.

6. SERVICES

1. Highgrounds BLVD offers exclusive membership to its private cannabis club and access to exclusive events hosted at its premises.
2. Highgrounds BLVD warrants that it shall:
   • Perform the services with utmost care and professionalism.
   • Take reasonable precautions to prevent loss due to the failure of its employees, agents, or contractors.
   • Ensure services are carried out in line with industry best practices.

7. FEES DEDUCTIONS AND PAYMENTS

1. The client shall be liable to pay the agreed fees in advance as set out in the service agreement or registration form.
2. Payments must be made in full without any set-off or deductions.
3. Highgrounds BLVD reserves the right to change fees with reasonable notice.

8. OBLIGATIONS OF HIGHGROUNDS BLVD

1. Highgrounds BLVD warrants and undertakes to:
   • Provide competent and reliable services.
   • Ensure that services are carried out in line with industry standards.

9. OBLIGATIONS OF THE CLIENT

1. You agree to:
   • Pay all fees and other amounts due in full and on time.
   • Provide accurate and up-to-date information.
   • Comply with all applicable laws and regulations in respect of the services provided.

10. WAIVERS AND LIMITATIONS OF LIABILITY

10.1 Highgrounds BLVD does not guarantee any specific outcome from the use of its services/products.

10.2 You indemnify Highgrounds BLVD against any claims arising from the use of their services and/or consumption of their products.

11. OWNERSHIP AND ACCESS

You retain ownership of any data or information provided for use on the Website. However, you grant Highgrounds BLVD the right to use this information as needed for service provision.

12. RELATIONSHIP BETWEEN THE PARTIES

Highgrounds BLVD provides services as an independent contractor and not as an agent, partner, or employee of the client.

14. CHANGES TO THE TERMS OF USE

15. GOVERNING LAW AND JURISDICTION

This Agreement will in all respects be governed by and construed under the laws of the Republic of South Africa, and any disputes arising will be subject to the exclusive jurisdiction of the Randburg Magistrate’s Court.
